You are selling an apartment with a beautiful extension, balcony or perhaps even an additional rooftop floor. While checking the documents, you find minutes confirming that the Owners\u2019 Association (VvE) approved the alteration years ago.<\/p>\n\n\n\n
Everything properly arranged, you might think.<\/p>\n\n\n\n
But is that approval legally sufficient?<\/p>\n\n\n\n
Not necessarily. And this is exactly where a real estate agent needs to pay attention.<\/strong><\/p>\n\n\n\n <\/p>\n\n\n\n With an apartment right, you are not only dealing with the physical property, but also with the deed of division (splitsingsakte<\/em>) and the VvE.<\/p>\n\n\n\n If the owners\u2019 meeting has approved an extension or balcony, this does not automatically mean that the new situation has been legally incorporated into the division.<\/p>\n\n\n\n Approval may also, depending on the circumstances, be withdrawn at a later stage. To properly and permanently formalise the altered situation, an amendment to the deed of division<\/strong> may therefore be necessary.<\/p>\n\n\n\n This is particularly important when the alteration changes the size or boundaries of the apartment right.<\/p>\n\n\n\n <\/p>\n\n\n\n This is where confusion often arises in practice.<\/p>\n\n\n\n A municipal permit and approval from the VvE are two separate matters.<\/p>\n\n\n\n The municipality assesses the alteration from a public-law perspective<\/strong>: is the proposed construction legally permitted?<\/p>\n\n\n\n The VvE and the deed of division concern the private-law side<\/strong>: is the owner permitted to make the alteration within the ownership structure of the building, and does the newly created area legally form part of that owner’s apartment right?<\/p>\n\n\n\n It is therefore perfectly possible to encounter an extension that has been properly permitted by the municipality but has not been correctly formalised within the VvE or deed of division. The reverse can also occur.<\/p>\n\n\n\n <\/p>\n\n\n\n Imagine you are selling an apartment with a 20 m\u00b2 extension. Naturally, those additional square metres play an important role in the presentation, floor area and value of the property.<\/p>\n\n\n\n Before putting the property on the market, you should therefore check:<\/p>\n\n\n\n Simply finding a sentence in old VvE minutes stating \u201cthe owners\u2019 meeting grants approval\u201d<\/em> may therefore not be enough.<\/p>\n\n\n\n <\/p>\n\n\n\n A good real estate agent adds value through much more than negotiating and selling property.
